Top 10 UAE VAT Errors That Trigger FTA Audits, and How to Avoid Them
2 min read

Most VAT penalties in the UAE do not come from fraud. They come from ordinary errors repeated return after return until an FTA review finds them, by which point the penalty has been running for months.

Since 14 April 2026, Cabinet Decision No. 129 of 2025 charges many VAT penalties monthly, so an error left in place now costs more the longer it stays. These are the ten we see most often.

The Ten Errors

Each of these is easy to make and easy to spot in a review:

  • 1. Recovering input VAT on blocked costs: client entertainment and cars available for private use
  • 2. Claiming input VAT without a valid tax invoice, or on an invoice addressed to someone else
  • 3. Zero-rating exports without the official and commercial evidence of export
  • 4. Getting the place of supply wrong for services to overseas customers
  • 5. Missing the reverse charge on imported services and goods
  • 6. Ignoring deemed supplies: gifts and samples above the annual limit, and goods taken for private use
  • 7. Treating designated zone supplies as outside the scope of VAT when they are not
  • 8. Reporting in the wrong period, especially for advance payments and deposits
  • 9. Tax invoices missing mandatory details such as the TRN or the VAT amount in AED
  • 10. Credit notes that do not match the original invoice

Why They Matter More in 2026

The amended VAT Law also lets the FTA deny input VAT where a transaction is linked to tax evasion and the business knew or should have known. A clean supplier file now protects input tax as well as reducing penalties.

Excess input VAT can also now only be carried forward or refunded within five years, so errors in recovery cost money as well as risking penalties.

How to Avoid Them

A VAT health check before the FTA asks is the cheapest fix. Review a sample of purchase and sales invoices against each of the ten areas, correct the process that caused any error, and use a voluntary disclosure for errors in returns already filed.

Frequently Asked Questions

What are the most common UAE VAT errors?

Recovering input VAT on blocked costs such as entertainment, claiming VAT without a valid tax invoice, zero-rating exports without evidence, and missing the reverse charge on imports.

Can I recover VAT on business entertainment in the UAE?

Generally no. Input VAT on entertainment for people who are not employees, such as clients, is blocked.

What happens if the FTA finds an error in my VAT return?

The FTA can issue a tax assessment for the unpaid tax with penalties. Since 14 April 2026, penalties under Cabinet Decision No. 129 of 2025 are largely charged monthly, so correcting errors early through a voluntary disclosure is cheaper.
