FAQs

UAE VAT, 6 Key Questions

What UAE businesses most often need clarified about VAT

Do I need to register for VAT if my business is not yet profitable?

VAT registration is based on taxable supplies (revenue), not profitability. If your taxable supplies exceed AED 375,000 in the previous 12 months, or are expected to exceed that threshold in the next 30 days, you must register, regardless of whether your business is making a profit. Many early-stage businesses overlook this and face retrospective registration penalties. GULF CONSULT monitors your VAT registration position proactively as part of our accounting and tax advisory services.

What is a VAT group and when should I consider one?

A VAT group allows two or more UAE-resident entities under common ownership (typically 51%+ common shareholding) to be treated as a single taxable person for VAT purposes. The main benefit is that supplies between group members are outside the scope of VAT, eliminating the cash flow and administrative burden of inter-entity VAT charges. VAT groups are particularly beneficial for holding companies, diversified business groups and businesses with significant intercompany service fees. GULF CONSULT advises on VAT group eligibility and manages the registration application.

What is reverse charge VAT and does it apply to my business?

Reverse charge VAT applies when a UAE-registered business receives services from a foreign supplier that does not have a UAE VAT registration. Under the reverse charge mechanism, the UAE recipient self-accounts for the VAT: declaring it as both output tax (payable) and, if eligible, input tax (recoverable) in the same VAT return. It also applies to certain goods imported from outside the UAE and to real estate and certain construction transactions. Many UAE businesses are unaware of their reverse charge obligations, particularly on subscriptions, software licences and professional services from foreign providers.

How does the FTA audit process work?

FTA tax audits are conducted under Article 20 of Federal Law No. 7 of 2017 (Tax Procedures Law). The FTA can audit any registered business within 5 years of the relevant tax period (15 years for fraud). The FTA typically issues an audit notification letter specifying the audit period and documents required. GULF CONSULT prepares a comprehensive audit file including all VAT returns, supporting ledgers, invoices, contracts and explanations before the audit commences, and manages all FTA interactions during the audit. Where assessments are raised, we prepare and file objections and appeals.

What is a voluntary disclosure and when should I file one?

A voluntary disclosure is a self-correction submitted to the FTA where you identify that a previous VAT return contained an error or understatement. Filing a voluntary disclosure proactively, before the FTA identifies the error, results in significantly reduced penalties (typically 5 to 30% of the underpaid tax) versus the standard 50 to 300% that applies when the FTA discovers the error independently. Voluntary disclosures can be filed at any time within the 5-year statute of limitations. The key is to file before the FTA issues an audit notification. GULF CONSULT conducts historical VAT reviews and manages voluntary disclosure filings.

Are healthcare and education services VAT exempt or zero-rated?

The treatment depends on the specific supply. Healthcare services are zero-rated (0% VAT) when performed by a qualified medical professional and listed in Cabinet Decision No. 74 of 2018, meaning the supplier charges 0% VAT but can recover input tax. Certain healthcare supplies that don't meet the qualifying conditions are standard-rated at 5%. Educational services are zero-rated for nursery through secondary school, and university education at approved institutions under Federal and Emirate government oversight: but private tuition, training, coaching and workshops are generally standard-rated at 5%. GULF CONSULT advises healthcare and education sector businesses on the correct VAT treatment for each of their supply types.

Is Your VAT Position Clean?

Many UAE businesses carry historical errors without knowing it. A VAT Health Check identifies and resolves issues before the FTA reaches you, at a fraction of the penalty cost.
