VAT Refund Deadline UAE: Claim Old Credits Before 31 December 2026
7 min read

Many UAE businesses carry excess recoverable VAT in their FTA account, sometimes for years. Until 2026 there was little pressure to claim it. That has changed. Amendments to the VAT Law and the Tax Procedures Law, in force since 1 January 2026, introduced a five-year time limit on refund claims, with a one-year transitional window for older balances. In practice, the key VAT refund deadline UAE businesses need to diarise is 31 December 2026. After that, some credits may be lost for good.

As of 18 October 2026. Based on Ministry of Finance (MoF) announcements and FTA service pages.

What changed on 1 January 2026

Two federal decree-laws came into force on 1 January 2026:

  • Federal Decree-Law No. 16 of 2025, amending the VAT Law (Federal Decree-Law No. 8 of 2017).
  • Federal Decree-Law No. 17 of 2025, amending the Tax Procedures Law (Federal Decree-Law No. 28 of 2022).

According to the MoF, the VAT amendments introduce a five-year time limit for submitting requests to reclaim excess refundable tax. Once that period passes, the right to reclaim expires. The same package also removed the requirement to issue self-invoices under the reverse charge mechanism (supporting documents must still be kept) and allows the FTA to deny input tax where a supply is connected to tax evasion. Businesses are now expected to verify the legitimacy of supplies before recovering input tax.

The Tax Procedures Law amendment adds a matching five-year limit, counted from the end of the tax period, to request a refund of a credit balance or set it off, with exceptions for credits that arise after that period or in its final 90 days.

The VAT refund deadline UAE businesses must not miss

The transitional rule is the most urgent point. The MoF has confirmed that where the five-year period expired before 1 January 2026, or expires within one year of that date, the taxpayer may still submit a refund request within one year from 1 January 2026. That window closes at the end of 2026, which is why we treat 31 December 2026 as the working deadline.

Who is most affected?

  • Exporters and businesses making mostly zero-rated supplies, which often sit in a refund position.
  • Companies that built up input VAT during set-up, construction or a large capital project.
  • Groups that restructured, deregistered entities or changed VAT grouping and left balances behind.
  • Businesses that chose to carry credits forward rather than claim them.

If your credit balance includes amounts from early tax periods (2018 to 2021 in particular), review them now.

How to claim a VAT refund in the UAE

Business refunds of excess recoverable tax are requested on EmaraTax using Form VAT311. The FTA's service page sets out these processing times:

StageFTA timeline
Complete application25 business days
Where an audit review is needed55 working days
Where additional documents are requestedA further 25 business days

Incomplete or poorly supported claims slow the process. Each period's balance should reconcile to your VAT returns, ledgers and tax invoices.

Step-by-step plan for the next ten weeks

  1. Pull your FTA account statement from EmaraTax and list the credit balance by tax period.
  2. Age the balance. Identify which amounts relate to periods whose five-year limit has passed or falls within 2026. These are your priority.
  3. Reconcile. Match each period to filed returns, the general ledger, and supporting tax invoices and customs records.
  4. Check input tax eligibility. Confirm that recovered input VAT relates to taxable supplies, that suppliers were VAT registered and that the new evasion-related denial rule is not a risk.
  5. Fix errors first. If you find mistakes in earlier returns, decide whether a voluntary disclosure is needed (see below).
  6. File VAT311 with a clear covering explanation and supporting schedules.
  7. Track and respond promptly to any FTA document requests.

Voluntary disclosures linked to refunds

The amended Tax Procedures Law allows a taxpayer to file a voluntary disclosure linked to a refund request within two years of filing that request. This helps where an error is discovered after a claim has been submitted. Under the April 2026 amendments to the Tax Procedures Executive Regulation, the MoF says voluntary disclosure procedures were clarified, refund procedures now apply to any credit balance, and record retention is extended by two years where a refund claim is pending.

Remember that a disclosure correcting an understatement of tax can trigger penalties. Since 14 April 2026, the revised penalty regime (Cabinet Decision No. 129 of 2025) applies a 1% monthly penalty on a disclosure made after the return due date but before any audit notice, and a fixed 15% plus the monthly 1% where disclosure follows an audit notification. Correcting errors early is cheaper.

Will a refund claim trigger an FTA audit?

Not automatically, but the FTA may review refund claims. The MoF has noted that the FTA can audit or assess after the usual limitation period in certain cases, such as a refund request filed in the final year of the limitation period. Your claim should therefore be audit-ready from day one: reconciled, documented and consistent with your financial statements.

Common mistakes to avoid

  • Assuming credits never expire. That is no longer true.
  • Claiming without reconciling. Unsupported balances invite queries and delays.
  • Ignoring input tax risks. Purchases from suppliers you cannot verify may be challenged.
  • Leaving it to December. With up to 25 business days for a complete claim, and longer if documents are requested, start well before year end.
  • Overlooking deregistered entities in a group that still hold balances.
  • Forgetting the record-keeping link. If a claim is pending, the April 2026 regulation changes extend retention by two years, so do not archive or destroy supporting files early.

Refunds for other claimants

This article focuses on business refunds of excess recoverable tax. Other refund schemes run on their own rules. UAE nationals building new residences must claim within 12 months of the home's completion, and the FTA published a new guide for this scheme (VATGRH1) in June 2026. Foreign business visitors with no UAE establishment can also apply for refunds, which the FTA processes within four months of receiving the original documents. Tourist refunds are handled separately through registered retailers. If you are unsure which route applies, check before filing.

Frequently Asked Questions

What is the VAT refund deadline in the UAE?

From 1 January 2026, excess recoverable tax must generally be claimed within five years. For older balances whose five-year period expired before 1 January 2026 or expires within 2026, the transitional window allows a claim within one year from 1 January 2026, so by 31 December 2026.

How long does the FTA take to process a VAT refund?

According to the FTA, 25 business days for a complete application, 55 working days if an audit review is needed, and a further 25 business days if additional documents are requested.

Which form do I use to claim a VAT refund?

Businesses claim excess recoverable tax through Form VAT311 on EmaraTax.

Can I correct my refund claim later?

Yes. The amended Tax Procedures Law allows a voluntary disclosure linked to a refund request within two years of filing the request.

Do I still need to issue self-invoices for reverse charge?

No. Since 1 January 2026, self-invoicing under the reverse charge is no longer required, although you must keep the supporting documents specified in the regulations.
