UAE Tax Penalties 2026: What Changed and What It Costs You
8 min read

The rules on UAE tax penalties in 2026 look very different from those many finance teams learnt when VAT arrived. Cabinet Decision No. 129 of 2025, which amends Cabinet Decision No. 40 of 2017 on administrative penalties, came into force on 14 April 2026. It replaced the old percentage-based late-payment charges with an annual rate charged monthly, and it reset the cost of correcting errors through voluntary disclosure.

This guide sets out what changed, the amounts that now apply, and the practical steps that keep your business on the right side of the Federal Tax Authority (FTA). It reflects the position as of 18 October 2026.

Which taxes the 2026 penalty regime covers

Cabinet Decision No. 40 of 2017 sets the administrative penalties for breaches of the Tax Procedures Law and the tax laws administered under it, mainly VAT and Excise Tax. The 2026 amendments therefore matter most to VAT-registered businesses and excise registrants.

Corporate tax penalties are set by a separate Cabinet decision. This article does not cover corporate tax penalty amounts. If you have a corporate tax issue, such as a missed return, treat it as a separate review.

The changes also sit alongside two other 2026 reforms:

  • Federal Decree-Law No. 17 of 2025, amending the Tax Procedures Law from 1 January 2026, introduced a five-year limit on refund claims and binding FTA directions.
  • Amendments to the Executive Regulation of the Tax Procedures Law, in force from 1 April 2026, clarified voluntary disclosure and refund procedures and extended record retention where a refund claim is pending.

Taken together, these reforms change both the cost of mistakes and the time you have to fix them.

The key UAE tax penalties in 2026 at a glance

The table below summarises the main amounts in the official consolidated version of Cabinet Decision No. 40 of 2017, as amended, published by the Ministry of Finance.

Late payment of tax due14% per annum, charged monthly for each month or part of a month on the unpaid tax
Voluntary disclosure after the return due date, before any audit notice1% per month on the tax difference
Disclosure after an audit notice, or no disclosureFixed 15% of the tax difference plus 1% per month

Late registrationAED 10,000
Failure to keep required recordsAED 10,000; AED 20,000 for a repeat

Always check the current consolidated text before relying on a figure for a specific case. Penalties depend on the facts, the dates involved and whether a violation is repeated.

Late payment: from fixed jumps to a monthly rate

The most visible change is to late payment. The amended decision applies a penalty of 14% per annum on unpaid tax, charged for each month or part of a month that the amount remains outstanding.

Law firm Al Tamimi & Company has noted that this replaces the previous approach of an initial percentage charge followed by a monthly percentage. Under the new approach, the cost grows steadily with time rather than in sharp steps. This works much like interest.

In practice, this means:

  • Cash-flow delays now cost a predictable amount. A short delay costs less than under a large fixed first-day charge, but long delays add up.
  • "Part of a month" counts. Paying a few days into a new month still triggers that month's charge.
  • Payment timing still matters. VAT returns and payments are due within 28 days of the end of the tax period. For a quarter ending 30 September 2026, the FTA lists 28 October 2026 as the final date.

Voluntary disclosure penalties in 2026

Voluntary disclosure remains the main way to correct a VAT return or refund claim that turns out to be wrong. What has changed is the cost, and the reward for acting before the FTA contacts you.

Disclosing before an audit notice

If you file a voluntary disclosure after the return due date but before receiving any notice of a tax audit, the penalty is 1% per month on the tax difference. The earlier you correct, the lower the cost.

Disclosing after an audit notice

If you wait until the FTA has notified you of an audit, or never disclose at all, the penalty becomes a fixed 15% of the tax difference plus the 1% monthly charge. Al Tamimi & Company notes that the comparable figure under the old rules was considerably higher, but the gap between acting early and acting late is still wide.

Errors with no tax impact

According to Baker McKenzie's review of the Tax Procedures Law amendments, errors that do not affect the amount of tax payable no longer need a voluntary disclosure and can be corrected in a later return. Confirm the treatment of your specific error before relying on this.

Disclosures linked to refunds

Federal Decree-Law No. 17 of 2025 allows a voluntary disclosure connected with a refund request to be filed within two years of the refund request. This matters because refunds of credit balances are now subject to a five-year limit from the end of the relevant tax period.

Filing, registration and record-keeping penalties

Fixed penalties continue to apply to administrative failures:

  • Incorrect return: AED 500. The amended decision provides that this does not apply where the error is corrected by the filing deadline, or through a disclosure with no tax impact.
  • Late filing: AED 1,000, rising to AED 2,000 for a repeat within 24 months.
  • Late registration: AED 10,000. VAT registration is mandatory once taxable supplies and imports exceed AED 375,000. Monitor your rolling turnover so you register on time.
  • Record-keeping failure: AED 10,000, or AED 20,000 for a repeat. Under the amended Executive Regulation, records must be kept for two further years where a refund claim is still pending.

Practical steps to reduce your penalty exposure

The new regime rewards businesses that find and fix errors quickly. A short internal routine can prevent most penalties.

1. Run a pre-filing review every period

Reconcile output VAT to the sales ledger and input VAT to purchase invoices before each return. Check reverse-charge entries, zero-rated exports and blocked input tax.

2. Schedule payments ahead of the 28-day deadline

Because late payment is charged monthly, set your payment date a few working days before the due date. This allows for bank delays.

3. Correct errors before the FTA asks

If you find an underpayment, assess it immediately. A disclosure filed before any audit notice costs 1% per month. One filed after a notice adds a fixed 15%.

4. Map your refund deadlines

Credit balances are now subject to a five-year limit. If your period expired before 1 January 2026 or expires within one year of that date, the Ministry of Finance says refund requests may be filed within one year from 1 January 2026. Make a list of every open credit and its deadline.

5. Tighten record-keeping

Keep tax invoices, credit notes, import documents and reconciliations in a retrievable format. Extend retention for any period with a pending refund.

6. Prepare for e-invoicing

The UAE's e-invoicing system goes live from 1 January 2027 for businesses with revenue of AED 50 million or more. It has its own penalties. Cleaner VAT data now will make that transition easier.

Frequently Asked Questions

When did the new UAE tax penalties take effect?

Cabinet Decision No. 129 of 2025, which amends Cabinet Decision No. 40 of 2017, took effect on 14 April 2026. The amounts in this guide come from the Ministry of Finance's consolidated version of the decision.

What is the VAT late payment penalty in the UAE now?

Unpaid tax attracts a penalty of 14% per annum, charged monthly for each month or part of a month that it remains unpaid. It works like an interest rate rather than a fixed jump.

How much does a voluntary disclosure cost under the 2026 rules?

If you disclose after the return due date but before any audit notice, the penalty is 1% per month on the tax difference. After an audit notice, a fixed 15% applies on top of the monthly 1%.

Do these rules apply to corporate tax?

No. Cabinet Decision No. 40 of 2017 covers penalties under the Tax Procedures Law for VAT and Excise Tax. Corporate tax penalties are set by a separate Cabinet decision, so review them separately.

Can I still avoid the AED 500 incorrect return penalty?

Yes. Under the amended decision, the penalty does not apply if you correct the error by the filing deadline, or if the correction is a disclosure with no tax impact.
